Argued: January 10, 2003 Appeal from the United States District Court for the District of Connecticut (Alvin W. Thompson, Judge) sentencing defendant Antonio Lasaga principally to 180 months' and 60 months' imprisonment, to be served concurrently, following his plea of guilty to receipt of child pornography in violation of 18 U.S.C. § 2252A(a)(2), and possession of child pornography in violation of 18 U.S.C. § 2252A(a)(5)(B). Lasaga appealed from his conviction for possession of child pornography, contending that the underlying statute is unconstitutional. He also appealed his sentence insofar as it included two upward departures. This court affirms Lasaga's conviction, but vacates and remands his sentence on the grounds that the district court erred by granting an upward departure under U.S.S.G. § 5K2.3.
